The Ministry of Communications (Department of Telecommunications) has officially notified the Telecommunications (User Identification) Rules, 2026 vide G.S.R. 750(E) on 21st August 2026 under the Telecommunications Act, 2023.
This regulation establishes a standardized, fraud-resilient, verifiable biometric identification framework for all telecom subscribers across India.
Key Highlights of the 2026 Rules
- 👤 Mandatory Biometric Verification: Biometric-based authentication is now statutory for new SIM issuance/enrolment, profile updates (Name, DOB, Gender), SIM replacements, and disconnection requests.
- 🪪 Two-Tier Authentication Framework:
- e-KYC Process (Rule 4): Biometric verification for individuals holding an Aadhaar number via the UIDAI framework.
- D-KYC Process (Rule 5): Digital verification for non-Aadhaar holders or individuals unable to undergo standard e-KYC due to physical impairment, disfigurement, or injury.
- 🏢 Business & Enterprise Connections: Mandates biometric identification for both the authorized representative of the enterprise and each individual end user assigned a SIM.
- 🔁 Strict Transfer Protocol: SIM/connection transfers are restricted exclusively to relatives or legal heirs, requiring fresh biometric verification and proper documentation (NOC, medical, or death certificate). Unofficial SIM reselling, leasing, or transferring is strictly prohibited.
- 🛡️ Zero Local Storage at PoS: Retail outlets and Points of Sale (PoS) are barred from retaining customer identity or biometric data locally. All captured data must securely transit straight to the telecom entity’s central repository.
- 🚨 Proactive Fraud Alerts (Rule 10): TSPs will push real-time alert notifications to existing numbers whenever a new SIM, modification, or disconnection is requested in a subscriber’s name, enabling users to freeze unauthorized activity instantly.
- ⚖️ Mandatory FIR for Impersonation: Telecom entities must immediately lodge a First Information Report (FIR) with law enforcement and inform the Central Government upon discovering forged documents, suppression of material facts, or impersonation.
